INTI CREATES CO., LTD. Content Posting Guideline

(General )

This document lays out guidelines for use of video and image content posted to any video sharing site by individuals or corporations (including streaming, hereinafter collectively referred to as Content) which includes game products (hereinafter referred to as “Our Games”) for which INTI CREATES Co., Ltd. (hereinafter referred to as “Our Company”) holds the rights .

 

(Terminology Definitions)

The terminology used in this document is defined as follows:

 

“Corporation”

A business or person affiliated with one whose primary operations include posting video content. This definition includes sole proprietorships under contract with larger productions and organizations.

 

“Individual”

Persons who are not affiliated with a corporation. This definition includes sole proprietorships not under contract with a corporation.

 

“Video sharing site”

Video sharing sites such as YouTube, NicoNicoDouga, and Twitch.tv, as well as social network sites such as X (formerly Twitter) and Facebook. However, sites with an age limit on viewership or sites that Our Company has deemed unsuitable are not included.

 

(Posting Video Content)

In regards to video, still image, and/or streaming video of an individual or corporation playing Our Games, it is allowed be posted to a video sharing site by the same individual or corporation for non-commercial purposes.

 

(Prohibition of Secondary Use of Video)

In regards to use of features of video sharing sites to monetize Content, Our Company consents to monetization of Content for games within the scope outlined in the Content Terms and Conditions (*see addendum), however secondary use of Content for profit is prohibited.

 

(Videos with Content Owned by a Third Party)

Should a post include content owned the rights by a third party other than Our Company, it will be necessary to obtain consent from that party.

 

(Videos with Music Content Owned by a Third Party)

Should a post include music content owned the rights by a third party other than Our Company, it will be necessary to obtain consent from that party or, should the rights to the music be entrusted to a rights management organization (such as the Japanese Society for Rights of Authors, Composers and Publishers (JASRAC), NexTone Inc., and the like), the video will need to be posted on a site that has a licensing agreement with that organization.

 

(Compliance with Video Sharing Site Rules and Guidelines)

All Content should adhere to the rules and guidelines of the video sharing sites it is posted to.

 

(Prohibited Items)

The following items are prohibited when posting Content. Any Content violating these items may be removed without prior warning and/or be subject to legal action.

 

①    Content violating the Content Terms and Conditions (*see addendum) for games as outlined in the Content Terms and Conditions.

②    Content which includes only artwork or animated/pre-rendered movies, removed from gameplay for the purposes of individual playback.

③    Content which includes only music, voice recording, or sound effect data, removed from gameplay for the purposes of individual playback.

④    Content containing alterations or adaptations of characters or stories from Our Games.

⑤    Content including gameplay featuring unauthorized modifications to Our Games (cheats, altered ROM data, illegal access, pirated copies, and the like).

⑥    Content including personal information or infringing upon the privacy of Our Company or a third party, or damaging to the character of the same.

⑦    Content infringing upon the intellectual property rights of a third party.

⑧    Content which uses characters, words, voice data, or the like removed from Our Games to promote specific ideologies.

⑨    Content which harms the distribution of Our Games or the business of Our Company.

⑩    Content which violates any law or violates the public order.

 

(Disclaimer)

Our Company cannot provide any guarantee regarding Content posted by our customers outside of establishing these guidelines. Our Company accepts no responsibility for any harm or disputes with third parties that may arise as a result of Content posted by our customers.

 

(Supplementary Provisions)

These guidelines may be subject to changes, additions, and removal at the discretion of Our Company. Understand that Content may be subject to removal based on changes to the guidelines at any time.

 

Understand that Our Company will not respond to individual inquiries regarding Content that follows these guidelines.

 

 

(*Addendum) Content Terms and Conditions Regarding Our Games

 

Any Content featuring Our Games are subject to the following terms and conditions.

 

[Games within 1 Year from Release Date]

・Content which includes footage from Opening to Ending in a single video is not allowed.

・Content including the Ending is not allowed to be monetized.

・Content including the Ending must include “Spoiler Warning” or similar in the title and description.

 

 

[Games Over 1 Year and within 3 Years from Release Date]

・Content which includes footage from Opening to Ending in a single video is not allowed.

・Content including the Ending must include “Spoiler Warning” or similar in the title and description.

 

 

[Games Over 3 Years from Release Date]

[Game Demos]

・No restrictions

 

 

“Release Date” is defined as:

・The release date listed on the official site for any of Our Games.

・In the case of a game releasing at different times on multiple platforms, the Release Date shall be the earliest release date among them.

 

“Opening” is defined as:

・”From the commencement of the game application until the earliest moment a player character can be controlled.”

(In the case of a game with no player character, or a game where it is unclear) “From the commencement of the game application until the earliest moment a player is given control of gameplay (options, settings, and the like excluded).”

・Button input to advance a movie or text is not be regarded as controlling a player character or giving a player control of gameplay.

 

“Ending” is defined as:

・”From the moment a player character can no longer be controlled until the game returns to the title screen.”

(In the case of a game with no player character, or a game where it is unclear) “From the moment the player can no longer control gameplay (options, settings, and the like excluded) until the game returns to the title screen.”

・Button input to advance a movie or text is not be regarded as controlling a player character or giving a player control of gameplay.

・Game credits are included.

・Without regards to the type of ending (applicable to all endings).
